| Web Site & Company Privacy
Policy
Document 1.3 published 1 January 2004
This is the web site of Webmarkworld.com a Webmark New
Zealand Limited wholly owned company.
(hereinafter also called 'we' or 'our')
This document details our Privacy Policies as
they apply to use of this Web Site and dealing with our company.
We respect and maintain your right to privacy,
with the highest regard.
Our company is founded and continues to operate on the
fundamental tenet of total confidentiality.
Our Web Server is set to automatically not
recognize nor store any information regarding the domain or e-mail
address of any visitor to our Web Site. We therefore have no ability
to store specific information about your visit, nor may we contact you
in any way as a direct result of that visit. However, in the case of
an order being placed via our secure commerce server, or a web-form
being filled, that server will record the IP address of the connection
making that order or submission, solely for the purposes of fraud
detection and prevention.
Logs and cookies: Our web server log files
record non-specific user information of a generic nature in an
aggregated-only form. Such information is used for internal review and
is then discarded, used to improve the content of our Web site, or
used to customize the content and/or layout of our site for a category
of user. We do not share such information with other third parties.
A cookie is a piece of data stored on the user’s computer tied to
information about the user-visit and may be used if a visitor's
browser is set to enable cookie usage. Usage of a cookie is in
no way linked to any personally identifiable information while on our
site. A cookie does not give us any personally identifiable
information about you. We may use both session ID cookies and
persistent cookies to enable a more complete browsing experience for
our users. Persistent cookies can be prevented or, removed by the
user, following Internet browser help file directions.
We do not use the methods generally described as "web-bugs"
or "traceable clear gifs", to track individual
information about a user's entry to, or, passage through our Web Site.
E-mail: We collect the e-mail addresses
of those who communicate with us via e-mail, or who submit information
by filling web-based forms. Such information is used to provide
service to those people and may be used by us to contact consumers for
marketing or customer relationship purposes.
If you do not wish to receive e-mail from us in the future, please let
us know by sending an email to us, calling us at the published
telephone number or writing to us at the published address and telling
us that you do not want to receive e-mail from our company.
Third parties: Where we use an outside credit
card processing company (bank) to bill users for services, such
company does not retain, share, store or use personally identifiable
information for any secondary purposes.
Links: This Web site may contain outbound links to other
sites. Please be aware that we are not responsible for the privacy
practices of such other sites. We encourage our users to be
aware when they leave our site and to read the privacy statements of
each and every Web site that collects personally identifiable
information. This privacy statement applies solely to
information collected by this Web site.
Business Transitions: In the event that our company
goes through a business transition, such as a merger, being acquired
by another company, or selling a portion of its assets, users’
personal information, if any, will, in most instances, be part of the
assets transferred.
Security: We appreciate that our customers and
potential customers reveal commercially sensitive information to us in
order to effectively use our services. Such information is considered
totally confidential by our directors and all members of our staff. It
will be treated with the highest regard.
This Web site and company uses our best endeavours to take every
precaution to protect our users’ information. When users
submit sensitive information via the Web site, their information is
protected both online and off-line.
When our request for service or order form asks users to enter
financially sensitive information (such as credit card or bank account
number), that information is encrypted and is protected with the best
encryption software in the industry - SSL. While on a secure
page, as an indication, the lock or key icon on the foot of Web
browsers such as Netscape Navigator and Microsoft Internet Explorer
becomes locked or unbroken, as opposed to un-locked, or open, when
users are just ‘surfing’.
While we use SSL encryption to protect sensitive information online,
we also do everything in our power to protect user-information
off-line. All of our users’ information, not just the
sensitive information mentioned above, is restricted in our offices.
Our offices are alarmed and monitored and all hard-copy and digital
information, and records are secured. Only employees who need
the information to perform a specific job (for example, our billing
clerk or a customer service representative) are granted access to
personally identifiable or commercially sensitive information.
Furthermore, ALL employees are kept up-to-date on our security and
privacy practices and are contractually bound to uphold them.
Any time new policies are added, our employees are notified and/or
reminded about the importance we place on privacy, and what they can
do to ensure our users’ information is protected. Finally, the
servers that store or process personally identifiable information are
in a secure environment, in a locked, guarded and monitored facility.
If users have any questions about the security at our Web site, users
can send an email to mail@webmarkworld.com
Correcting, Updating, Deleting, Deactivating Personal
Information: If a user’s personally identifiable information
changes (such as zip code, phone, email or postal address), or if a
user no longer desires our service, we provide a way to correct,
update or delete/deactivate users’ personally identifiable
information.
A user may ask us to provide a copy of such information as we might
hold about them and we undertake to correct such details as may be
irrelevant or no longer correct .
This can be done by emailing us: mail@webmarkworld.com
Notification of Changes: If we decide to change our privacy
policy, we will post those changes to this privacy statement, on this
page, and other places we deem appropriate so our users are always
aware of what information we collect, how we use it, and under what
circumstances, if any, we disclose it.
If, however, we are going to use users’ personally identifiable
information in a manner different from that stated at the time of
collection we will notify users via email and by posting a notice on
this Web site for 30 days.
Disclosure required by legal
authority: Though we make every effort to preserve user privacy,
we may need to disclose personal information when required by law
wherein we have a good-faith belief that such action is necessary to
comply with a current judicial proceeding, a court order or legal
process served on our Web site or company.
Effect of law: If any provision of this document is found by a
court of competent jurisdiction to be invalid, the parties
nevertheless agree that the court should endeavour to give effect to
the parties' intentions as reflected in the provision, and the other
provisions of the document remain in full force and effect. You agree that
regardless of any statute or law to the contrary, any claim or cause
of action arising out of or related to use of our services must
be filed within six (6) months after such claim or cause of action
arose or be forever barred.
The section titles in this document are included for convenience
only and have no legal or contractual effect.
